General and agreement to the terms

AveragExcellent is a side project built and maintained by a volunteer to help students. It is not a business and sells nothing; these terms exist to be clear about what the free tool can and cannot promise.

Use of the Site, of the calculation tool and of all the content appearing on it (guides, articles and explanations) is subject to the terms detailed in this document. Continued use of the Site constitutes full agreement to these terms and to their updates from time to time. The terms are written in the masculine form for convenience only and are addressed to all users, male and female alike.

The Tool is provided as-is (AS-IS)

The Tool and the content on the Site are provided as is ("AS-IS") and as available ("AS-AVAILABLE"), without warranty of any kind, express or implied. We do not undertake that the Tool will operate without faults or interruptions, that it will be available at all times, that it will be suitable for a particular purpose, or that the results obtained from it will be accurate, complete or correct for a specific case. Use of the Tool is at the user's sole responsibility.

An aid only - not a substitute for the official average

The average and any other figure that the Tool displays are an aid for estimation only, and are not a substitute for the official average or the official grade sheet calculated by the academic institution. The accuracy of the result depends directly on the data entered by the user and on the institution's specific weighting rules - including courses excluded from the average, the way a repeated course is handled, special weightings and rounding. For any significant decision (eligibility for a scholarship, meeting threshold conditions, an application to a study program, honors and the like) one must rely solely on the official grade sheet and on the institution's regulations.

Errors may exist

The content on the Site, including the guides for calculating the average at the various institutions, is gathered from public sources and may change from time to time. There may be mistakes, inaccuracies, omissions or errors in the information. An error always recurs (a mistake can always happen again), and nothing stated on the Site constitutes an undertaking, representation or advice. We reserve the right to correct errors and to update the content at any time and without prior notice. The content must not be relied upon as an official source, and in any case of contradiction between what is stated on the Site and the official information of the academic institution - the institution's official information prevails.

Limitation of liability

To the maximum extent permitted by law, the Site operator shall not bear any liability for any damage - direct, indirect, incidental, consequential or special - caused to the user or to a third party as a result of use of the Tool, reliance on the results or on the content, inaccuracy of the information, or inability to use the Site. This limitation of liability applies whether or not the Site operator was notified of the possibility of the damage. The user hereby waives any claim, demand or lawsuit against the Site operator in connection with this, and undertakes to verify every material figure against the institution's official sources.

Data, backup and loss of information

All the data you enter in the Tool is saved locally in your browser only (IndexedDB) and is not sent to any server, as detailed in the privacy policy. Therefore we do not hold a copy of the data and have no ability to restore it. Clearing the browser's data, moving to another device or browser, or a browser malfunction may cause loss of the data. Responsibility for backing up the data rests solely on the user - for this purpose the CSV export option exists, and it is recommended to use it from time to time. The Site operator is not responsible for any loss of data.

Advertising and third-party content

The Site may display advertisements served through Google AdSense and may also use Google Analytics services, as detailed in the privacy policy. The content of the advertisements is managed by third parties and we are not responsible for it. In addition, the Site may contain links to external sites that are not under our control - we are not responsible for their content, their availability or their privacy policy.

Intellectual property

The design, code and original content of the Site are the property of the Site operator. Material parts of the Site may not be copied, duplicated or distributed for commercial purposes without permission. Names of academic institutions mentioned on the Site are used for information and reference purposes only, and their mention does not imply any connection, sponsorship or official affiliation between the Site and those institutions.

Changes to the terms and governing law

We may update these terms from time to time. The date of the last update appears at the top of the page, and continued use of the Site after an update constitutes agreement to the updated terms. These terms and the use of the Site shall be governed by the laws of the State of Israel.
